The Garden State’s new “enhanced shield law” criminalizes speech, protects rogue doctors, and elevates the “right” to kill unborn children and mutilate born ones over moral and constitutional law.
On the heels of an aggressive effort to smear, investigate, and shut down pro-life pregnancy centers, New Jersey has passed legislation that critics say will criminalize pro-life speech and potentially even prayer near abortion clinics.
Last Thursday, New Jersey Gov. Mikie Sherrill, D, signed S2260, a bill she claims protects “reproductive health services” for women and gender-confused minors, as well as abortionists from “malicious out-of-state legal actions.”
In a statement, Sherrill — who earlier this year signed a law allowing abortions up to birth if a single “certified fetal-maternal specialist” deems it necessary to save a mother’s physical or mental health — explained her reasoning for approving the new “enhanced” shield law by stating,
“We have seen attacks from the Trump Administration and other states on access to reproductive and gender affirming healthcare, and attempts to impose restrictions across state borders. Here in New Jersey, we are standing firm in defense of reproductive freedoms – including the right to choose and the right to receive gender-affirming care.”
S2260 is sweeping in its scope. For example, the law establishes a new crime of “interference with reproductive healthcare services.” Interference doesn’t only involve blocking access to a clinic, intimidating someone, or defacing property; a person can be charged with a felony if they cause a patient or healthcare worker “mental anguish” or “emotional harm.”
A violation of the law carries with it a penalty of up to 18 months in prison and a $10,000 fine. If the charge is upgraded, a convicted defendant could receive as many as 10 years in prison and a $150,000 fine.
In addition, S2260 creates a private right of action for businesses, doctors, and others to file lawsuits against those convicted under the law and allows judges and juries to award punitive damages, attorney’s fees, and up to $1,000 in compensatory damages for each violation.
Critics claim that the law’s ban on “interference with reproductive health services” and its use of language such as “intimidate, threaten, or coerce” could allow peaceful protesters, people praying, or sidewalk counselors who stand near abortion clinics and seek to offer alternatives to abortion to be criminally tried.
“It goes way beyond protecting doctors into prosecuting pro-life advocates and any voices who would be open and critical of these procedures and these services,” said Shawn Hyland, director of advocacy for the New Jersey Family Policy Center.
The law bears a striking resemblance to the Freedom of Access to Clinics Entrances (FACE) Act, a federal law passed in 1994 that was weaponized by the Biden administration against peaceful pro-life protesters in the wake of the Dobbs decision overturning Roe v. Wade — even as the Department of Justice (DOJ) largely ignored hundreds of physical attacks on pro-life pregnancy centers and conservative churches.
In January 2025, President Donald Trump pardoned all 23 peaceful pro-life protesters who were prosecuted and found guilty by the Biden administration under the FACE Act.
Mark Houck, a pro-lifer who was arrested at his house in an early morning raid by 16 FBI agents and tried for FACE Act violations, was the only target actually acquitted by a jury; he later received a $1 million settlement with the DOJ for its mistreatment of him.
Speaking with Fox News, Houck said he believed New Jersey’s new law is “FACE Act 2.0” and characterized it as equally unjust.
Notably, S2260 orders state courts to consider a defendant’s previous violations of the FACE Act when imposing civil penalties.
S2260 does far more than create a state-level FACE Act, however. It also strengthens New Jersey’s shield law protections for doctors, patients, and those who assist with procedures that are illegal in other states.
The Freedom Center has written in depth about the ongoing issue of progressive shield laws, which have been passed in states like New York, New Mexico, and Washington, to undermine pro-life laws in other states.
For example, New York passed its shield law to provide immunity and anonymity to abortionists, including Dr. Margaret Carpenter, who sent abortion drugs to the mother of pregnant teenager in violation of Louisiana’s law banning the cross-state shipment of abortion drugs to Louisiana residents. That teenager was forced to take the pills against her will and ended up in a local ER with severe hemorrhaging.
Some states have also passed laws shielding doctors who perform gender transition procedures on out-of-state minors, going so far as to provide cover for anyone, including unrelated adults, who transports a child across state lines for mutilating surgeries.
But in New Jersey, S2260 adds another nuance to the debate, refusing to comply with not only other states’ law enforcement entities but also with the federal government.
As the Trump administration has pursued charges against medical systems that provide gender transition treatments to minors, New Jersey’s law bars officials from cooperating with any effort by the federal government to arrest doctors who provide illegal gender transition procedures.
The law also prohibits insurance companies from declining to cover services due to disciplinary or legal action taken against a provider by another state for conducting an abortion or gender transition.
Carol Tobias, president of National Right to Life, issued a press release saying,
“S2260 attempts to prevent other states from enforcing their laws while shielding abortion providers who reach across state lines. This is not about protecting women’s health. It is about protecting abortion providers and expanding an industry whose purpose is the death of an unborn child.”
Hyland said the law “goes beyond being a shield, it’s a sword. It’s using the power of government to target pro-life advocates for standing for life even outside of abortion clinics.”

Like other blue states, New Jersey is elevating the rights of women and doctors to kill, mutilate, and sterilize children, both unborn and born, over moral and constitutional law.
In this way, they are following the lead of Europe. In the U.K., for example, pro-lifers are routinely arrested and tried in court for silently praying or holding up signs with Bible verses or offering a voluntary conversation near abortion clinics, while a Christian teacher was fired and jailed for refusing to use a student’s preferred pronouns.
In America, this type of state-mandated censorship is unconstitutional.
The City of Greensboro, North Carolina, found that out when it was forced to settle with members of the pro-life organization Love Life after arresting them for praying and counseling women outside of an abortion clinic. City leaders admitted that the arrests were for the “exercise of constitutionally protected First Amendment rights.”
The intent of the New Jersey law is not to protect women or bodily autonomy or doctors providing valuable services; it is to thwart and undermine the laws of other states and the federal government, silence dissent, shield doctors from accountability or transparency, and promote abortion and gender transitions.
S2260 will certainly be challenged in federal court, but if this law is not blocked from taking effect, its true intent will be obvious — not only in how it was written but in how it is enforced.
Per the definitions provided in the law, one could very easily argue that pro-life clinics should also be protected as they provide pregnancy counseling, ultrasounds, and other reproductive health services. But just like the FACE Act, which is supposed to equally protect pro-life pregnancy centers and churches, S2260 won’t be enforced against vandals and arsonists who target them.
In other words, the era of one-sided FACE Act persecutions against pro-lifers has now moved to the state level.
How should pro-lifers respond? In the words of Mark Houck: “Do what we’ve always done, which is to be peaceful and prayerful” and continue to stand up for life and against tyranny.
